These Rules are the official rules (the "Rules") that apply to individuals ("You" or the " Participant") who enter the "Win a Complete Pair" Contest (the "Contest"). By entering the Contest, you agree to abide by and be bound by these Rules and any interpretation of them by FYi Eye Care Services and Products Inc. and FYi Services and Products Quebec Inc (where applicable). (collectively, the "Sponsor").

1. Eligibility

1.1.  This contest is open to all legal residents of Canada who are 18 years of age or older.

1.2. The following persons are not eligible to enter the Contest:

1. Employees of Sponsor, its subsidiaries, affiliates or related companies, and their respective representatives, advertising agencies, promotional agencies and media; and
2. Employees and immediate family members of the persons listed in section 1.2a and any person residing at the same address as them.

2. Participation

2.1. To enter, participants must fill out the form with their email address, full name, phone number, interests and agree to the contest terms via the link in the email, “Wanna take a chance on free?"

2.2. Once the form is successfully submitted, the Participant will be eligible to participate in the monthly contest.

3. Duration of the contest

3.1. Contest entries will be accepted from August 1st, 2023 at 12:00:01 a.m. (EDT) until the contest closes on August 31, 2023 at 11:59:59 p.m. (EDT).

4. Prize Winners

4.1. The draw will take place on September 7th, 2023 at approximately 12:00 PM (MT) at FYidoctors offices at 300   2424 4th Street SW, Calgary, AB T2S 2T4, and each “Winner” will be notified by the Sponsor's representative.

4.2. A total of one (1) Prize per Winner drawn (each as defined below) will potentially be awarded up to a maximum of five (5) Winners.

4.3. Sponsor will make reasonable attempts to contact each Winner via email within one (1) business week, but in case Sponsor is unable to contact a Winner within thirty (30) days of selection, the selection of that Winner may be declared null and void.

4.4. In the event that a Participant’s selection is declared void, invalid or he/she is disqualified or declines a Prize, the Sponsor will cancel such Prize.

4.5. Except for the foregoing, Sponsor reserves the right, at its sole discretion, to cancel a Prize if Sponsor is unable to award a Prize.

5. Awards and additional eligibility criteria

5.1 . There is are (5) individual prizes (the “Prizes”) to be won by up to a maximum of five (5) Winners. No Participant may receive more than one Prize. Each Prize to win consists of:

1. One (1) complete pair of glasses with lenses up to a value of $1000. Each prize is non-transferable and additional terms and conditions may also apply.

5.2. All shipping and handling costs incurred in delivering each Prize to each Winner will be paid in full by the Sponsor. The Sponsor is not responsible for any loss, damage or breakage of any Prize that occurs during or after delivery of a Prize to a Winner.

5.3. Any additional costs beyond those expressly listed above are not included in a Prize and must be paid in full by the applicable Winner.

5.4. Each Prize must be accepted as awarded. The Prizes are not transferable; there is no cash alternative or other exchange except as noted below. No substitution is possible.

5.5. Sponsor reserves the right to exchange a Prize or Prize item for another prize or item of equal or greater value, if applicable (and may be cash or a cash-equivalent of equal value).

5.6. To be eligible to receive a Prize, each Winner must correctly answer a time-limited mathematical skill-testing question at a mutually convenient time and place.

6. Disqualification

6.1. Sponsor reserves the right to disqualify any Contest entry that it determines, in its sole discretion, to be in violation of these Rules.

6.2. Without limiting the generality of the foregoing, if Sponsor has reason to believe that an entry is fraudulent or is an attempt to disrupt, tamper with or undermine the legitimate operation of the Contest, Sponsor may, at its sole discretion, disqualify any entry or declare the entry invalid or void. The decisions of the Sponsor are final, and no correspondence or discussions will be initiated in this regard.

6.3. Any attempt to deliberately damage Sponsor through social media or to undermine the legitimate operation of this Contest may be a violation of civil and criminal laws and, should such an attempt be made, Sponsor fully reserves the right to seek damages and, where permitted by law, to seek criminal prosecution.

7. Responsibility

7.1. To the extent permitted by applicable law, all Participants and Winners shall not hold responsible, and shall indemnify and hold harmless: Sponsor and its affiliates, and their respective representatives, agents employees, directors or shareholders, from any and all : claim(s), action(s), cause(s) of action, suit(s), petition(s), loss(s), damage(s) (including any accidental loss or accidental damage), liability(ies), failure(s), cost(s) and expense(s) (including any professional or legal fees, any expense, any interest, any penalty fees or amount(s) paid in settlement) suffered or incurred by the Sponsor or its affiliates or their respective representatives, agents and employees, directors or shareholders, as a result of, or resulting directly or indirectly from, or in connection with the Participant's or Winner's participation in the Contest or acceptance of a Prize. All Participants voluntarily accept this legal risk, and hereby expressly waive any right of action and accept any physical risk that may be associated with their participation in this Contest or acceptance of a Prize.

7.2. Sponsor and its affiliates, and their respective representatives, agents, employees, directors or shareholders shall not be responsible for any injury to the Participant or damage to any computer related to or resulting from participating in or downloading materials from this Contest. Participants assume all liability for injuries caused or claimed to be caused by participation in this Contest or by the acceptance, possession, use or non-receipt of any Prize.

7.3. Each Winner will be required to sign a declaration, waiver or release in similar terms to those used in Sections 7.1 and 7.2 before he/she is eligible to receive a Prize.

8. General terms and conditions

8.1. By entering the Contest, Participants consent to the publication, reproduction and/or other use of their name, address, voice, statements regarding the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including but not limited to print, television, radio and Internet advertisements.

8.2. The Sponsor reserves the right to terminate or modify this Contest, subject to the approval of the Régie des alcools, des courses et des jeux du Québec ("Régie"), in any way, without notice or obligation, in the event that any cause beyond the reasonable control of the Sponsor potentially interferes with the operation of this Contest as described in these Rules.

8.3. This Contest is subject to all applicable federal, provincial and municipal laws.

8.4. If any term or condition of the Rules is found by a court of law to be illegal, invalid or unenforceable for any reason, such term or condition shall be removed from the Rules and the remaining terms and conditions shall continue in full force and effect.

8.5. Winners are required to notify Sponsor as soon as possible if they are unable to claim a Prize for any reason.

8.6. If, for any reason, a person who was not pre-selected as a Winner is awarded a Prize (e.g., a substitute prize), that person will be deemed to be the Winner for purposes of these Rules.

8.7. In the event of any dispute regarding the conduct or results of the Contest, these Rules or any other matter relating to this Contest, the decision of the Sponsor is final, and no correspondence or discussions will be initiated.

8.8. By entering this Contest, each Participant expressly consents to the Sponsor, its agents and/or representatives, collecting, retaining, sharing, disclosing and using the personal information submitted as part of his/her entry solely for the purpose of administering the Contest in accordance with the Sponsor's Privacy Policy unless another agreement has been made with the Participant. Each Winner consents to the disclosure of their name by the Sponsor on the Sponsor’s web and media sites and in accordance with the Rules.

8.9. Quebec Residents, any litigation regarding the conduct or organization of this Publicity Contest may be submitted to the Régie des alcools, des courses et des jeux ("Régie") for a ruling. Any litigation regarding the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
